To pursue rent and service charge arrears we offer either
- a no recovery - no fee, or
- a fixed fee service for Landlords and Managing Agents.
If you need to recover arrears of rent, service charge or other monies under a lease or if you simply want your tenant evicted we can assist.
We will recover legal costs, interest, lost profits and disbursements from the tenant.
We will work on a no recovery no fee basis up to the point of issue of court proceedings. We also offer fixed fees for Section 8 and Section 21 proceedings.
Most tenancy agreements and leases allow us to recover the costs of the proceedings from the tenant. Of course this is always subject to the tenant being able to pay the monies due. We will review the merits of further enforcement action with our clients at every stage so as not to incur unnecessary expenses and costs.
A simple statement of the amount owed including dates when arrears became due and a copy of the tenancy agreement is all we need to get the ball rolling.
If the debtor tenant is still resident in the property, we are able to offer pre-action letters demanding payment of rent arrears either on a no recovery no fee or fixed fee basis. We recommend that prior to instructing us a landlord or landlord's agent sends a 7 day demand letter to attempt to make a recovery of arrears prior to our involvement and we can provide the necessary letter templates for this action.
Do you just want to get the tenant out of the property ?
We charge a set fee of £75 plus VAT to issue a section 21 notice, which demands the tenant leave by a specific date. If the Tenant is unco-operative then we will issue accelerated possession proceedings at a fixed fee of £395 plus VAT (inclusive of the court issue fee). We ask you to fund the issue fee and we claim the rest from the tenant.
Do you want to to get the tenant out of the property and also claim for arrears of rent ?
We will issue a section 8 notice at a cost of £75 plus VAT. Court fees for the issue of possession proceedings in undefended matters are £525 plus VAT (inclusive of the issue fee). In the unlikely event that the matter is defended (most are not) we will provide a full estimate of the cost involved in further action. We ask you to fund the issue fee and we claim the rest form the tenant.
To recover rent ,service charge, other items such as insurance rents from tenants as well as your costs together with statutory or contractual interest we will issue a Section 146 notice for £75.00 plus VAT.
To further pursue the debt through the court we charge a fixed fee of £395.00 plus VAT inclusive of the court costs. Once again we claim these costs from the tenants – all we ask is that you fund the issue fee.
Where the tenant has a mortgage we can recover the arrears following judgement by claiming the funds from the mortgagees. The tenant will pay the arrears and costs to avoid possession proceedings which would wipe out their security - mortgagees
As part of our service to you, we also offer a fixed fee for the issue of Pre-Action letters – otherwise known as '7 Day Letters' for £60.00 plus VAT.
